Patient who sued after fall from Beaufort Memorial Hospital window denied retrial

A man who fell out of the window of his fourth-story room at Beaufort Memorial Hospital and later lost his lawsuit claim of negligence against the hospital has been denied a retrial, according to court filings.

Danny Prince was brought in to the Beaufort hospital on February 13 1999, after suffering a work injury. Though initially a typical patient, Prince "experienced a psychotic hallucination in his hospital room and was found by Hospital staff at 11:20 p.m. on the roof of a lower floor with injuries to his ankles and head," according to a court filing.

Prince sued the hospital in 2001 claiming negligence, and the court ruled in the hospital's favor.

Prince eventually was granted a new trial due to certain hospital records not being turned over to Prince and his attorneys.

But a decision handed down today by the South Carolina Court of Appeals reverses the awarding of a retrial, effectively a judgement in favor of the hospital.
