Judge strikes down rezoning tactic used to OK Marion Square hotel plan

Catch is while the judge said Charleston was wrong to grant this type of selective rezoning to the developer, in an earlier case he said that it was OK for the city to grant a variance at the site currently occupied by the old Charleston County Public Library on Marion Square (map.)

So unless preservation groups can successfully appeal the variance, they can't stop the 10-story hotel.
